Beachwalk Vacation Rentals Policies

Beachwalk Vacation Rentals serves as the agent & representative of all Owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the Owners.

ACTS OF GOD / CONSTRUCTION NOISE

Neither Owner nor Beachwalk shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to; Acts of God, acts of government agencies, fire, strikes, war, inclement weather or a pandemic. NO REBATE OR REFUND will be offered in these circumstances.

ALCOHOLIC BEVERAGES PROVISION
No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed. Should a Guest(s) or guest of Guest(s) be arrested for underage drinking at property or should Agent(s) observe a Guest(s) or guest of Guest(s) under the age of 21 drinking alcoholic beverages, this rental agreement may be terminated, and the Guest(s) evicted at the discretion of Management. Illegal drug use is strictly prohibited anywhere on the Property.

ALCOHOLIC BEVERAGES LIQUIDATED DAMAGES
Guest(s) recognizes and agrees that by allowing Guest(s) to use Owner’s home, Owner is relinquishing an inherently personal thing to Guest(s) and, thus, Owner places a high degree of trust in Guest(s) that Guest(s) will treat the Property with the utmost respect.  To that end, Guest(s) agrees that any violation of the Alcoholic Beverages provision included in this contract, including but not limited to the use of illicit drugs, is a serious violation of Owner’s trust and thus causes Owner substantial damage.  These violation of trust damages are inherently difficult to measure and, thus, Guest(s) agree that any violation of the Alcoholic Beverages provision above shall entitle Owner to agreed liquidated damages for that violation of trust in the amount of $5,000.  Of course, Owner also retains the right to pursue actual damages to the property resulting from the violation.  Guest(s) further agrees that in the event it is found by a court to be in violation of the Alcoholic Beverages provision, Guest(s) shall pay all of Owner’s attorneys’ fees and costs.

AMENITIES/ LOCAL ATTRACTIONS
Should the Property you are renting offer any amenities or indicate closeness to amenities or local attraction including but not limited to the use of a pool, hot tub, basketball court, tennis court, use or access to the beach, fishing or boating, please note that these amenities are not guaranteed as part of your house rental reservation.

CANCELLATIONS
A cancellation made sixty (31) days or more prior to check-in date are subject to the non-refundable reservation fee plus 10% of the rental rate. Cancellations made 0 to 30 days prior to arrival are non-refundable and non-transferrable. A transfer to another home is considered a cancellation. All cancellations must be made via phone with a live reservationist by calling 800-814-7501 or via email at beachwalkvacation@gmail.com. A cancellation via voicemail is not valid.  An updated statement will be emailed to you following a cancellation as proof of the cancellation. If you do not receive an updated statement showing your cancellation, please contact the Beachwalk Vacation Rentals office immediately.

CHECK-IN/ CHECK-OUT TIME
Standard check-in time is 4:00 p.m. and standard check out time is 10:00 a.m.  These times are strictly enforced over the summer months.

A late check-out fee of $50.00 per half hour will be applied to those who fail to vacate the Property by check-out time.During the off-season months check-in and check-out times may be flexible. Please call our office 48 hours prior to your arrival at 800-814-7501 to request an early check-in or late check-out, additional fees apply.

Most Properties have time activated door codes and therefore will not function upon an unauthorized early arrival or following an unauthorized late departure.

CHECK-OUT PROCEDURES
•Make sure all refuse is in outside trash and recycle bins. Do not leave trash on countertops, tabletops or other surfaces within the Property.
•Place any dirty dishes in dishwasher and start.
•Turn off all lights and fans, close and lock windows.
•Adjust thermostat(s)-Air Conditioner up to 78 / Heat down to 60

Failure to follow check-out procedures will result in a fee of $50.00 for these additional housekeeping services.

CLEANING SERVICES
Standard departure cleaning and linen replacement are the financial responsibility of the renter and included in the total due for the reservation. The cleaning and linen fee is shown as a separate line item and is not included as part of the rental fee, this is a non-negotiable charge. During your stay, if you are not satisfied with the cleanliness of the home, please contact the office immediately at 800-814-7501. Our policy is to correct cleaning issues, not refund any monies. Standard cleaning does not include tasks covered in the check-out procedures.

CONSTRUCTION
If Guest(s) have selected a property, which is under construction, and the property is not completed prior to Guest(s) arrival date, we will use every effort to locate comparable accommodations at similar rates. Neither Beachwalk Vacation Rentals nor Owner will be liable to Guest(s) beyond the obligation to refund to Guest(s) all payments made.

CREDIT CARD
Guest(s) providing a credit card number as a guarantee do agree to pay all rent and/or any outstanding charges and accept all terms of the lease agreement during the term of the lease with Beachwalk Vacation Rentals. Any charges incurred during the stay or additional charges added (late check out, excessive cleaning, pet fee or other violations.) may be automatically charged to the credit card given as guarantee.

DAMAGE WAIVER
Guests are responsible for any damages that occur during occupancy. However, a $40.00 non-refundable damage waiver protection fee is included in the total price of the reservation. This damage waiver does NOT cover intentional damage, theft, or excessive cleaning charges. Damage waiver protection provides coverage of up to $300.00 in unintentional damages to the property. Damages must be reported prior to departure to be eligible.

FIREPLACES
Should your Property have a fireplace please ensure the gas is turned in OFF position when not in operation. Contact the office should you want assistance with the fireplace during your stay. Do not allow fireplace to run for extended periods of time, especially if a TV is installed above the fireplace. Use of a fireplace is at your own risk.

FIREWORKS (including sparklers) are strictly prohibited in and near all Properties at all times.

GOLF CART USE
Should the Property indicate it offers a golf cart for your use, please note this is a seasonal add-on and are not included during the cooler months. A separate Release of Liability as well as acknowledment of the rules for golf cart use is required and provided separately.

HOMES FURNISHINGS AND EQUIPMENT
All homes are privately owned, furnished, and equipped by its OWNER. As such, Beachwalk Vacation Rentals cannot make any changes to the furnishings or equipment provided by the owner. Décor, style and color will vary and are subject to change without notice. Under no circumstances are furniture, bedding, mattress pads, utensils or any other property supplied with the rental property to be taken or transferred from one property to another. Moving of furniture is prohibited, and evidence of such will result in a charge of $50.00 deducted from the security deposit to cover our placing items back to their original location.

HOT TUBS
If applicable to the Property, the hot tub will be cleaned prior to your arrival. Should you require an additional cleaning during your stay you may request this service. For more information including, the cost of this service, please contact the Beachwalk Vacation Rentals office.  Use of a hot tub is at your own risk. NEVER leave children unattended near the hot tub.  When hot tub is not in use always have it covered and locked.

HOUSEHOLD SUPPLIES PROVIDED
A small initial supply of bath soap bars, toilet tissue (2 rolls per bathroom), dish soap, laundry (a few pods) and trash bags are provided but are not replenished.

INDEMNIFICATION AND HOLD HARMLESS
Guest(s) agree to indemnify and save harmless the Owner and Beachwalk Vacation Rentals for any theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for golf cart accidents, personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms “Agent(s)” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents and representatives where the context requires or permits. The term “Guest(s)” and “Your” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during the Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits.

LINENS AND TOWELS PROVIDED
The supply of linens and towels that are provided is equivalent to the reported occupancy of the home. Bed linen and bath towels are not replaced during your stay.

LOCKOUT POLICY
In the event a Guest is locked out of a property please call 1-800-814-7501 for assistance.

LOST & FOUND
Although we cannot be held responsible for items left behind, we do make every effort to locate and return items left behind. Contact our office and “found” items may be mailed back to Guest(s) at the Guests(s) expense. Shipping charges must be placed on a major credit card.

MINIMUM AGE
Beachwalk Vacation Rentals does not rent Properties to individuals under the age of 25 unaccompanied by a parent for the duration of the stay. ID’s must be furnished upon request. If under 25 years of age, you will not be allowed to check into any Beachwalk Vacation Rentals property and all monies paid will be forfeited.

OCCUPANCY
Rental homes are not to be used to host any type of party or event without prior approval from Beachwalk Vacation Rentals. Occupancy in use of premises shall not be such as to infringe on the quiet enjoyment of its neighbors at ANY time during your stay. Guest(s) certify that they have read carefully the limitations placed on the number of persons permitted to occupy the premises, and will abide by such limitations; if not, Guest(s) will be asked to vacate the property which will result a forfeiture of all monies paid.

ONLINE RESERVATIONS
If you place your reservation online, it may take up to 24 hours for your credit card deposit to be processed.

OWNER LOCKOFFS

Certain areas in each rental property are locked for the OWNERS storage and are not included in the rental. These areas are locked and not included in the rental of the Property.

PETS
Most properties do not allow pets or emotional support animals.  If an unauthorized pet is discovered after check-in, occupancy will be terminated with no refund. If our cleaning staff finds evidence of a pet upon departure, additional cleaning fees of $150.00 will be applied to Guest(s) credit card on file.

PROM PARTIES

No prom (or similar) parties are allowed without prior approval and, if approved, require additional rental fees, additional deposits and multiple adult chaperones, no exceptions. Suspected underage rentals will be investigated and if found to violate these terms, will be asked to leave without refund for unused time.

QUIET TIME
Quiet time is 10 p.m. Please make sure music is turned down and noise levels are kept to a minimum following this time (especially while enjoying the outdoor areas of the home). Repeated occurrences of failure to quiet down may result in the termination of this contract without refund of unused time.

RATES
All rates are subject to state and local tax.

REPAIRS – SERVICE CALLS – MAINTENANCE ISSUES
Beachwalk Vacation Rentals cannot guarantee against mechanical failure of heating, air conditioning, hot water heaters, refrigerators, ovens, televisions, cable/satellite receivers, DVD players, modems, routers or other appliances or equipment. Please report any inoperative equipment to our office immediately. We will make reasonable effort to have repairs done quickly and efficiently or move Guest(s) to a different property if possible. Should a repair person be called to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for the service will be the Guest(s) responsibility. Guest(s) understands and agrees that Beachwalk may enter the rental property at any time for the purpose of making any needed repairs. Our policy is not to refund or adjust rates for mechanical failure, but to respond quickly in an attempt to avoid any inconvenience.

RETURNED CHECKS
A $39.00 service charge will be incurred for any returned checks.

RIGHT OF ENTRY
Guest(s) agree that Beachwalk reserves the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, to make repairs, alterations or improvements as the Beachwalk Vacation Rentals staff may deem appropriate.

SECURITY DEPOSIT

A REFUNDABLE security deposit is collected on most homes. Any damages, excessive cleaning, theft or other damages not covered under the damage waiver described above will be deducted from this security deposit.  All deposits, less any damages, will be refunded within 10 business days of departure by Beachwalk Vacation Rentals.  Please allow additional time for the credit card processing company to credit your account.

If a pet is allowed there may be an additional fee. Properties that allow pets are clearly identified as pet friendly properties in the description.

SMOKING
No Smoking is allowed inside any of our rental accommodations which also includes electronic cigarettes and vapes. Outside smoking is permitted but please do not litter. If smoking has been detected inside of the Property, a fee of $250 will be charged to the credit card on file as an additional cleaning fee.

TELEPHONES / INTERNET
Most rental homes do not have a landline. Some Properties may not receive strong cellular service. Should you need to make a call throughout your stay, please stop by the local rental office and we’d be happy to assist you.

All of our Properties do have internet connectivity. We cannot guarantee an internet connection will be available due to mechanical/equipment failures. Each OWNER is responsible for the installation and upkeep of internet modems and routers. We will do our best to troubleshoot issues and contact Owners/repair service as needed in the event your internet connection is not working correctly; however, we do not employ a technician. It is against our Policy to refund any rent because of internet related failures.

TERMINATION BY OWNER/SUBSTITUTIONS
Beachwalk Vacation Rentals strives to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances. Beachwalk Vacation Rentals cannot absolutely guarantee a specific rental property. Beachwalk Vacation Rentals reserves the right to change assignments without notice should the unit or property become unavailable. When comparable accommodations are not available, Guest(s) will have the option of selecting from available properties at the published rate or receiving a complete refund of their reservation deposit. If no substitution is available, Beachwalk Vacation Rentals will attempt to give as much notice as possible, so other arrangements can be made.

TAX EXEMPTIONS
In order to be tax exempt from state sales tax, you must provide a tax-exempt certificate prior to check-in.

WEBSITE INFORMATION
Every effort is made to ensure that information is accurate and complete on our website and our partner websites. However, Beachwalk Vacation Rentals will not be liable for any statistical or text errors.

You will receive an electronic version of this document that must be electronically signed prior to your arrival. Additional arrival instructions will be sent to you prior to your arrival.
